British Columbia introduced new sick note restrictions under Bill 11 in November 2025, making BC one of the most recent provinces to limit when employers can require physician documentation for short-term absences. Under BC's updated Employment Standards Act, employers are prohibited from requesting a sick note for the first two health-related absences of five or fewer consecutive days per calendar year. The legislation treats absences for the employee's own illness and absences taken to care for an ill family member as separate buckets — meaning an employee could have two absences for personal illness and two for a sick family member before an employer could request documentation, depending on the circumstances. After two qualifying absences or for any absence extending beyond five consecutive days, employers can request what the Act describes as reasonably sufficient proof that the employee was unable to work. That proof does not need to be a physician's note specifically, but a physician-issued note remains the most commonly accepted and least disputed form of documentation.
Victoria has a particularly large proportion of workers in BC's provincial public sector, healthcare, the federal public service, tourism and hospitality, technology, and post-secondary education.
