Halifax is Nova Scotia's largest city and one of the fastest-growing urban centres in Atlantic Canada. It is also situated in a province that consistently records the highest per-capita family doctor shortage of any in the country. Nova Scotia's Need a Family Practice Registry, which tracks residents waiting to be matched with a family physician or nurse practitioner, has grown dramatically since 2021. At its peak, the waitlist surpassed 160,000 Nova Scotians — representing more than 16 percent of the entire provincial population waiting for a primary care provider. The Halifax Regional Municipality and surrounding central zone account for more than half of those on the list, with over 47,000 residents in the HRM area alone waiting for a family practice attachment at one point.

Wait times to be matched with a new family physician through Nova Scotia's registry commonly exceed 24 to 60 months, and in some parts of the province there is no rostering capacity at all. Retirements are the primary driver, with approximately a quarter of Nova Scotia's active physicians over the age of 60 and approaching retirement age. Population growth compounds the problem: Statistics Canada data shows more than 492,000 residents now live in Halifax, accounting for 58 percent of Nova Scotia's recent growth, and around 30 percent of new additions to the family practice registry identify as new to the province. Doctor's notes in Halifax: Nova Scotia's Medical Certificates for Employee Absence Act explained

Nova Scotia was the first province in Canada to pass dedicated legislation specifically governing when employers can request sick notes from employees. The Medical Certificates for Employee Absence Act came into effect on July 1, 2023, making Nova Scotia a national model that several other provinces have since followed or referenced when drafting their own sick note restrictions.

Under the Act, Halifax employers who are provincially regulated — which covers approximately 90 percent of businesses in Nova Scotia — can only request a medical certificate from an employee in two specific circumstances. First, if the employee has been absent for more than five consecutive working days. Second, if the employee has already had at least two separate absences of five or fewer working days due to sickness or injury within the preceding 12 months. Outside of those two thresholds, Halifax employers cannot require a physician-signed note regardless of the reason for the absence or how long the employee has been with the company. An employer who violates the Act can face a complaint to Labour Standards and a financial remedy ordered against them.

The Act also broadened who can sign a sick note when one is required. Rather than being limited to a physician, a valid medical certificate in Nova Scotia can now be issued by any regulated healthcare provider who is actively providing care to the employee — including registered nurses, nurse practitioners, dentists, pharmacists, physiotherapists, and social workers. This change was driven by the province's recognition that requiring physician signatures was unnecessarily burdening an already strained healthcare system. Doctors Nova Scotia estimated that physicians in the province were spending 50,000 hours per year writing sick notes before the legislation took effect.

There are important exceptions Halifax employees need to be aware of. The Act applies to provincially regulated employers only. It does not apply to federally regulated workplaces, which include financial institutions, airlines, federal Crown corporations, federal civil servants, and telecommunications companies. Employees of those organisations in Halifax remain subject to the Canada Labour Code's rules for sick documentation instead. Additionally, the Act does not prevent Halifax employers from requiring a return-to-work certificate after an employee returns from an extended absence, or from requiring the medical documentation specified under other leave provisions in the Labour Standards Code, such as serious illness or injury leave. Under Nova Scotia's Stronger Workplaces for Nova Scotia Act, which came into force on January 1, 2025, employees are entitled to 5 unpaid sick days per year and up to 27 weeks of unpaid job-protected leave for serious illness or injury.
