Doctor's notes in Montreal: what Quebec's sick leave rules say in 2026
Quebec's sick leave framework operates under the Loi sur les normes du travail, administered by the CNESST (Commission des normes, de l'equite, de la sante et de la securite du travail). The rules were updated in 2026 following the passage of Bill 68, which placed new restrictions on when employers can request medical documentation for short absences.
Under the updated Act respecting labour standards, Quebec employers are prohibited from requiring a medical certificate for the first three short-term absences of three consecutive days or fewer within a rolling 12-month period. The intent is to reduce the burden on Quebec's strained healthcare system and stop employers from requiring employees to seek clinic appointments for minor illnesses. Quebec joined Ontario, British Columbia, Nova Scotia, New Brunswick, Prince Edward Island, Newfoundland and Labrador, and Saskatchewan in implementing similar restrictions, reflecting a national trend of provinces scaling back short-term sick note requirements.
Quebec's baseline sick leave entitlement under the Loi sur les normes du travail provides two paid sick days per year after three months of continuous service, plus up to 10 days per year total for illness, family obligations, or other personal responsibilities, of which the remaining eight days beyond the two paid days are unpaid. For longer illness requiring an absence of more than three consecutive days beyond the protected threshold, employers can request supporting documentation. For absences that extend to a serious medical condition, Quebec law provides up to 26 weeks of unpaid, job-protected leave after three months of service, and documentation from a physician is required to support and maintain that leave.
As with every other province, the restrictions on requesting sick notes apply only to short statutory absences within the defined threshold. They do not affect extended medical leaves, return-to-work clearance requirements, short-term or long-term disability benefit applications, or documentation required under a collective agreement. Montreal's largest employers across finance, aerospace, technology, pharmaceuticals, and the public sector all maintain their own internal HR policies for extended absences that require physician-issued documentation.
