Doctor's notes in Saskatoon: Saskatchewan's new sick note rules effective January 1, 2026

Saskatchewan introduced the most comprehensive update to its employment standards legislation in years on January 1, 2026, and Saskatoon employees need to understand exactly what changed and what it means for sick leave documentation at their workplace.

Under amendments to the Saskatchewan Employment Act that came into force on January 1, 2026, employers in Saskatchewan are now restricted from requesting a medical certificate unless one of two conditions is met. Either the employee has been absent for more than five consecutive working days, or the employee has already had two non-consecutive absences of two or more working days within the preceding 12 months. Before this change, Saskatchewan had no meaningful restriction on when employers could ask for sick notes, meaning Saskatoon employers could legally request documentation from day one of any absence. The new rules bring Saskatchewan in line with Nova Scotia, Ontario, Quebec, and BC, all of which had already introduced similar restrictions in the years prior.

The January 2026 amendments also extended Saskatchewan's long-term serious illness leave from 12 weeks to 27 weeks per calendar year, aligning the province with the federal EI sickness benefit period of 26 weeks. This is a substantial increase that gives Saskatoon employees dealing with serious illness, major surgery, or extended mental health conditions significantly more job-protected leave than was previously available under provincial law. A medical certificate confirming the nature and expected duration of the leave is still required to access the 27-week protection, and employers must reinstate the employee to the same or a comparable position upon return.
